Enforces Article 13-F of the NYS Public Health Law, also known as the Adolescent Tobacco-Use Prevention Act (ATUPA). ATUPA was created to help prevent the sale of tobacco products and accessories to anyone under the age of 21. Tobacco products include cigarettes, cigars, bidis, chewing tobacco and powdered tobacco, rolling papers, smoking paraphernalia, or any other tobacco products. ATUPA has been amended to also prohibit the sale of vapor products, including electronic cigarettes and liquid nicotine, to anyone under the age of 21. ATUPA also bans all flavors of vapor products, with the exception of tobacco flavor. To file a complaint or report a retailer that is selling to anyone under the age of 21 or is selling flavors illegally, please contact the ATUPA Bureau.

Provides a wide variety of services essential to the health and well-being of all Genesee County Residents. Service areas include public water supply protection, community sanitation and food protection, private water and sewage disposal systems, realty subdivision plan review, public health nuisances, residential lead investigations, chemical emergencies, rabies investigations, and enforcement of both the Adolescent Tobacco Use and Prevention Act (ATUPA) and the NYS Clean Indoor Air Act (CIAA). The Environmental Health division also operates multiple anti-rabies immunization clinics annually to administer vaccines to domestic animals, including cats, dogs, and ferrets, in order to reduce the spread of the potentially life threatening disease.

Conducts property transfer surveys which includes bacteriological water analysis and testing of on-site waste water treatment systems. Regulates all public water supplies as defined by Part 5 of the NYS Sanitary Code. Oversees cooling tower registry and reviews water testing results. Investigates special issues including rabies, radon, nuisance complaints, smoking in public, emergencies related to Public Health, West Nile Virus/Eastern Equine Encephalitis, mosquito vector surveillance, and control measures as warranted. Provides free rabies clinics for dogs, cats and domesticated ferrets in various locations throughout the year. Call or go online to find locations and register. Oversees permitting and enforces the NYS Sanitary Code for Bathing Beaches, Children Camps, Swimming Pools, Temporary Residences, Tanning Salons, and Tattoo and Piercing Parlors. Erie County's ATUPA (Adolescent Tobacco Use Prevention Act) Program is part of a comprehensive state wide enforcement program designed to reduce the prevalence of tobacco use, and to attempt to prevent tobacco access to youth less than 18 years of age. The program coordinator maintains an up to date listing of registered and unregistered tobacco retail dealers and vendors (including cigarette vending machines) within the County. All facilities are visited yearly by program personnel to verify that they are properly registered with the New York State Department of Taxation and Finance to sell tobacco products; that proper signage regarding the sale of tobacco products to minors is conspicuously posted; and that tobacco products are properly and safely stored to prevent access to unauthorized individuals. Additionally, at least one compliance check per year with underage youth is done at each facility where tobacco products are available for sale, to verify that such products are not being sold to minors.

Responsible for septic systems, inspections and permit issuance, drinking water testing, public health hazards and nuisances, clean indoor air enforcement, onsite wastewater treatment system regulation, rabies investigations and vaccinations, insect control, West Nile Virus surveillance. Rabies vaccinations: Conducts free rabies vaccination clinics for dogs, cats and domesticated ferrets in several locations across Cattaraugus County. All Cattaraugus County residents are eligible for these free vaccinations. Notices will be posted on the Cattaraugus County website, through radio, newspaper ads, fliers on community boards around the County.
